The German points system works in ranges, not in single trigger numbers — and with two periods that start from different events.

Overview

What the register is

Germany keeps one central register of driver-aptitude entries, held in Flensburg, and the points on it are not a scoring game — they are a measure of fitness to drive. That framing explains the parts of the system that otherwise look arbitrary: why the top rung is not discretionary, why expiry runs per entry rather than per driver, and why a training seminar can remove a point at the bottom of the ladder but not at the top.

An offence reaches the register through a decision, not through an accusation. Until a decision is final there is nothing to record, and this is the first place foreign drivers are misled: a notice in your hand is not yet an entry.

Entry classes

There are three sizes of entry. An ordinary listed administrative offence is one point. A serious administrative offence, and most criminal traffic offences, are two. A criminal offence that came with withdrawal of the licence, or a bar on reissuing it, is three.

Which offence sits where is fixed by an annex to the driving-licence ordinance, in three literal lists of catalogue numbers. The fine catalogue itself contains no points at all, so every points figure you see on this site — including every zero — is a join between the fine catalogue and that annex.

Process

Two clocks that must never be confused

This is the mechanism most explanations get wrong, in both directions.

For the MEASURE, what counts is your total as at the date of the offence — the Tattag — of the last contributing violation. Points attach retroactively to that day once the decision becomes final. So the rung you land on is decided by where you were on the day you did it, not by where you were on the day the letter arrived.

For EXPIRY, the period runs from the date the decision became unappealable — the Rechtskraft. Never from the Tattag. A slow proceeding therefore delays the start of expiry while leaving the measure exactly where it was.

For seminar entries a third date does the work: the date the participation certificate was issued. Both the eligibility snapshot and the multi-year lock key on that date.

Research

Expiry, holdover, and the special clock

Each entry expires on its own schedule: 2,5 years for a one-point entry, 5 years for a two-point entry, 10 years for the three-point class.

The three-point class also has a start rule of its own — its period begins when a new licence is granted rather than when the decision became final, with a backstop period so that it cannot run indefinitely. Our data set carries the special-clock mechanism; the backstop is described here without a figure because it is not typed in the reviewed values.

Expiry is also not deletion. For a further 1 year after an entry has expired it remains on the register under a holdover rule, usable only for restricted purposes. Anyone reasoning about a total should therefore distinguish three states, not two: active, expired but held over, and erased.

Process

Resets and wipes

Two mechanisms move a total downwards other than expiry. If a rung was skipped because measures were issued out of order, the total is reset to that rung's own ceiling as at the date of the notice that skipped it — 5 where an admonition was missed, 7 where a warning was. And where a licence is newly granted after it was withdrawn, the total is wiped, subject to carve-outs in the statute.

Neither is a discretionary favour. Both are consequences of the register's own rules about the order in which measures must be taken.

Process

The seminar credit

A driver-aptitude seminar removes 1 point, and only under four conditions at once: a standing of 1 to 5 points, no more than once in 5 years, a certificate submitted within 14 days of the seminar ending, and the eligibility measured at the certificate's issue date. Above that standing the statute expressly excludes the credit.

What does not exist

Below the register threshold, no points arise

An offence is entered only where the imposed fine reaches 60 €, or a driving ban was ordered. Below that, and with no ban, the offence produces zero points however it is listed in the annex. This is the difference between "carries one point" as a property of the offence and "produced one point" as a fact about your notice.

What does not exist

The driver-aptitude seminar has no statutory price

The statute governs who may deliver the seminar, what it does to the register and by when the certificate must be submitted — not what it costs. We searched the seminar's own provision for a fee, a charge, a price or a currency and found none, and we then checked the Act's general power to make regulations, in case a fee-setting power was delegated rather than fixed: it does not mention the seminar at all. Seminars are run by private providers at market prices. A figure here would be a claim about a market rather than about the law, so this site does not make one.

Details

What the seminar consists of

The seminar behind that credit is defined by structure rather than by a syllabus. It has two parts and both are mandatory: a traffic-pedagogical part and a traffic-psychological one, which the statute requires to be coordinated with each other.

The split is defined by WHO may deliver each part, not by what each part contains. The pedagogical part is delivered by driving instructors holding a specific seminar authorisation under the driving-instructors act; the psychological part by holders of a separate seminar authorisation, granted and supervised by the authority competent under the law of the Land, with qualification requirements and a continuing-education duty of its own. The statute nowhere defines the two terms in prose — the delivery role is the definition, which is worth knowing before reading a provider's description of what a seminar "is".

The participation certificate is issued by the provider of the psychological part, and its issue date is what everything else keys on: the eligibility standing above, the multi-year lock, and the deadline for submitting it. That is the same anchor the credit provision itself uses, so the two provisions agree rather than compete — we checked them against each other rather than assuming they matched.

Querying your points balance

Nobody has to guess their own balance in the driving-aptitude register: § 30 Abs. 8 StVG gives every person concerned a right to disclosure of the register’s content and the number of points — free of charge.

Free by statute

The disclosure is free of charge — the statute itself says so. Paying for the bare query means paying for something the law provides for free.

  2. Applying in writingA written application must be signed by hand, with proof of identity enclosed. The disclosure is issued in writing.
