What an imprint is, and why § 5 DDG applies

The imprint (Impressum) is the provider identification a German website is legally required to carry. Anyone in Germany who provides a digital service on a commercial basis — that is, with some permanence and not purely privately — must keep certain details easily recognisable, directly accessible and permanently available. Since the 2024 digital-services legislative package the basis is the Digitale-Dienste-Gesetz (DDG, the German Digital Services Act): the general information duties now sit in § 5 DDG and have replaced the former § 5 of the Telemediengesetz (TMG). Older imprints and many guides still cite "§ 5 TMG"; that reference is superseded. In addition, § 18(1) of the Medienstaatsvertrag (MStV) requires substantially the same details; its paragraph 2 adds, for journalistic-editorial services, the naming of a responsible person, and expressly refers to §§ 5 and 6 DDG.

A calculator — a function that applies published tables and deadlines uniformly — is not a journalistic-editorial service. On the view taken here, the duty under § 18(2) MStV is therefore not triggered; the § 5 DDG details, by contrast, are treated as binding because the service is public and commercial. Should an editorial part be added later, the corresponding section below will be completed.

Details under § 5 DDG

The service provider within the meaning of § 5 DDG is the person or company responsible for this service. The mandatory details below are added before the official launch. No field is filled in advance with invented data.

Service provider — name and service addresspending

The name, street and number, postcode and town — and, if outside Germany, the country — will be published before launch.

Contact — email plus a second, fast channelpending

The responsible contact is reachable by email now at [email protected]. A second, fast contact channel — usually a telephone number — is added at launch; with the final domain, the email address moves to that domain’s info@ mailbox.

§ 5(1) no. 2 DDG (a contact form alone is not regarded as sufficient; a telephone number is the usual second channel).

If the operator is entered in a register, the registry court and registration number will be named here. Otherwise the detail falls away; a registration number is never invented.

§ 5(1) no. 4 DDG (only where registered; if the operator is not entered in the commercial, association, partnership or cooperative register, this block falls away entirely).

VAT identification numberpending

Where a VAT identification number has been issued to the operator, it will be stated here. If there is none, this block falls away entirely — a number is never invented.

Responsible for the content (§ 18(2) MStV)

A separate person responsible for content under § 18(2) MStV must be named only for journalistic-editorial services. This service consists of calculators and explanations of published provisions and is not currently editorial. The detail therefore falls away for as long as no editorial part is added; if one is added, a natural person will be named here with a name and service address.
